PlanTrust Terms of Use

1. Acceptance of Terms

By accessing or using the PlanTrust website, software applications, and services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use our Services.

2. Description of Services

PlanTrust provides technology-driven solutions for pension plan management, including but not limited to:

  • Plan benchmarking tools
  • Data analysis services using Form 5500 data

3. User Accounts

3.1. To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party.

4. Use of Services

4.1. You agree to use the Services only for lawful purposes and in accordance with these Terms.

4.2. You agree not to:

  • Use the Services in any way that violates any applicable federal, state, local, or international law or regulation
  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services
  • Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

5. Intellectual Property Rights

5.1. The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by PlanTrust, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5.2. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services.

6. User Content

6.1. Our Services may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“User Content”). You are solely responsible for the User Content that you post to the Services.

6.2. By posting User Content to the Services, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Services.

7. Third-Party Links and Content

The Services may contain links to third-party websites or services that are not owned or controlled by PlanTrust. PlanTrust has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

8. Disclaimer of Warranties

8.1. The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied.

8.2. PlanTrust makes no warranty that:

  • The Services will meet your requirements
  • The Services will be uninterrupted, timely, secure, or error-free
  • The results that may be obtained from the use of the Services will be accurate or reliable

9. Limitation of Liability

In no event shall PlanTrust, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

10. Indemnification

You agree to defend, indemnify, and hold harmless PlanTrust and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of your use and access of the Services, or a breach of these Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State], United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect.
